1. PARTIES & DEFINITIONS: This document constitutes a binding agreement between the undersigned Participant (or Parent/Legal Guardian if Participant is a minor) and Helgemo Haven ("Sponsor"), its owners, employees, agents, and representatives. "Equine Activities" includes, but is not limited to, riding, handling, training, grooming, boarding, spectating, or assisting with horses, ponies, or mules.
2. ACKNOWLEDGEMENT OF INHERENT RISKS: The Participant acknowledges that horses are unpredictable by nature and that participating in equine activities involves substantial inherent risks. These risks include, but are not limited to: (a) the propensity of an equine to behave in ways that may result in injury, harm, or death to persons on or around them; (b) the unpredictability of an equine's reaction to such things as sounds, sudden movement, and unfamiliar objects, persons, or other animals; (c) certain hazards such as surface and subsurface conditions; (d) collisions with other equines or objects; and (e) the potential of a participant to act in a negligent manner that may contribute to injury to the participant or others.
3. RELEASE AND WAIVER OF LIABILITY: To the fullest extent permitted by law, the Participant hereby releases, waives, discharges, and covenants not to sue Helgemo Haven, its owners, officers, and employees from any and all liability, claims, demands, or causes of action arising out of or related to any loss, damage, injury, or death that may be sustained while participating in equine activities, whether caused by the inherent risks of equine activities or general negligence.
4. HELMET REQUIREMENT (FLORIDA LAW): Pursuant to Florida Law, all riders under the age of 16 are strictly required to wear an ASTM-approved protective helmet while mounted. The Sponsor highly recommends that participants of all ages wear protective headgear at all times when handling or riding equines.
5. DISCLOSURE OF HEALTH & ABILITY: The Participant certifies that they possess a sufficient level of physical fitness and skill to safely participate in equine activities. Participant agrees to follow all verbal and written instructions provided by the Sponsor or its representatives.
